The ECHR found violation of freedom of expression in three cases from Azerbaijan
On July 8, the European Court of Human Rights (ECHR) announced decisions on several complaints from Azerbaijan.
Lawyer Khalid Agaliyev told Turan that two decisions came from complaints of journalists Elnur Mammadov and Idrak Abbasov about violations of their freedom, personal inviolability and freedom of expression.
As for Elnur Mammadov, the ECHR found violations of his rights under Articles 5 (right to freedom and personal inviolability) and 10 (freedom of expression) of the European Convention on Human Rights and Freedoms.
Note that the right of Idrak Abbasov was violated under Article 10 (freedom of expression).
The Strasbourg court decided to pay Mammadov a monetary compensation of 6, 000 euros, and Abbasov - 4500 euros.
Also, the applicants will receive another 1,000 euros for court costs. The complaint was related to an incident in 2009 when Mammadov and Abbasov were injured while covering a police operation in the editorial office of the newspaper "Milli Yol".
Plainclothes prevented the reporters from filming - they insulted them, twisted their hands, took away the cameras, etc.
Mammadov was forcibly taken away in a car and dropped off in a place unknown to him.
The ECHR also recognized the violation of rights of now deceased citizen Ali Hasanov under Article 10 of the European Convention and decided to pay compensation worth1,700 euros in the case. In 2008, he was sentenced to 6 months of imprisonment on a defamation claim for publications in the newspaper "Ideal". In spite of the fact that the publications were under other names, the court found Hasanov guilty who denied his complicity for the publications.
